Determining When Harassment Is Illegal Can Be Tricky

 

At what point harassment becomes illegal harassment is not always clear and can be difficult to determine.  Indeed, courts are not always clear on the matter.  The discrimination laws were not intended to be a “code of civility” and do not prohibit simple teasing, offhand comments, or isolated incidents that are not very serious.  Harassment is illegal if it is so frequent or severe that it creates a hostile or offensive work environment or if it results in the victim being fired or demoted or the like.  These types of acts by the employer are adverse employment decisions.

If frequent or severe, harassment can occur by slurs, graffiti, offensive or derogatory comments, or other verbal or physical conduct. With respect to sexual harassment, harassment can occur by unwelcome sexual advances, requests for sexual favors, and other conduct of a sexual nature.
